Q: What Form do I complete to claim costs?
A: Form 1 Rep 3
Q: What do I need to send in with my Rep 3 form?
A: Vouching documentation for any outlays in the form of fee notes/receipts. In cases where a medical/expert report has been sought, forward a copy of the report. In cases where counsel has appeared in an uncertified capacity, forward their fee note. In all cases, vouching documentation must be original and feature original signatures. You need only send ONE copy of the report.
Q: Do I pay Counsel directly in uncertified cases and claim the money from NILSC?
A: No. Under the provisions of the current Criminal Proceedings (Costs) Rules (Northern Ireland) 1992, the Commission will pay counsel directly for his appearance. The assessment of fees for solicitor and non certified counsel are made under Rule 7 (3) of the Criminal Proceedings (Costs) Rules NI.
Q: How long do I have to submit my Rep 3?
A: The Rep 3 must be forwarded to the Commission within three months of the completion of the case.
